I always thought it to be an article of faith that everyone, no matter how despicable, was entitled to legal representation. This was a hallmark of our legal system. Obviously this is no longer the case. The lawyers presenting election challenges have been subject to every manner of ridicule, harassment and threats. To date I have read one post in the Law Journal, a letter to the editor, commenting on this event. Where is the New York State Bar Association, the ACLU or any other “prominent” group or commentator. The silence is deafening. Free speech, and indeed the freedom and ability to hire counsel, is at best on life support. Moreover, the casual acceptance and/or complicity of every major legal institution and organization is nothing short of astonishing. It is a sad time in America. Lenny Bruce said that “in the halls of justice the only justice is in the halls.” We now have reached the point where cases which are not in favor with the majority opinion won’t even make it to the halls.
